Sitemap Trends — Terms of Service

1. Acceptance of Terms

Welcome to Sitemap Trends (“we”, “our”, “us” or “the Service”). Sitemap Trends is operated by an individual operator / sole proprietor. These Terms of Service (“Terms”) govern your access to and use of the Sitemap Trends service, accessible at https://sitemaptrends.com (“the Service”), which provides daily-updated rankings and statistics of trending keywords in the online (mini-)game website space, based on aggregated, publicly available sitemap metadata.

By creating an account, subscribing to a plan, or otherwise using the Service, you confirm that you: (a) are at least 18 years old; (b) have read, understood and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or the organization you represent.

If you do not agree to these Terms, please do not use the Service. Continued use of the Service after we update these Terms constitutes acceptance of the revised Terms.

2. Description of the Service

2.1 What we provide

Sitemap Trends is a data analytics SaaS product. We aggregate publicly available sitemap metadata (URL lists, game names, and indexation statistics) from online game distribution websites, and present daily-updated rankings that help website operators research content and keyword directions. The Service is delivered entirely as a digital, internet-based software service (SaaS).

2.2 Nature of the Service

The Service is a digital, intangible product. Access is activated immediately upon confirmation of payment. Because of the immediate-delivery nature of digital services, refunds are subject to the specific limits set out in Section 5.

2.3 Nature of the underlying data

The data we display consists of factual metadata (game names, counts of indexing domains, growth rates) derived from publicly available sitemap files. We do not republish the content of third-party websites, and the data we process does not contain personal information of individuals.

3. Accounts

3.1 Account creation

You must create an account with accurate and complete information to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Account security

  • If you suspect unauthorized use of your account, contact us immediately at contact@sitemaptrends.com.
  • Do not share your login credentials with any third party.
  • Keep your billing email address valid at all times.

3.3 Organization accounts

If you register on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

4. Subscriptions, Billing and Payments

4.1 Free trial

The Service offers a free trial of 7 days. No payment method is required to start the trial. The trial does not auto-convert into a paid subscription; after the trial ends you decide whether to subscribe.

4.2 Subscription plans

Paid access is offered on a subscription basis at the price displayed on our Pricing page at the time of purchase (currently USD $29 per quarter). The billing interval is stated at checkout and on the Pricing page.

4.3 Payment processing (Merchant of Record)

Payments are processed by Dodo Payments, which acts as the Merchant of Record for your purchase. This means Dodo Payments is the seller of record for payment, tax and invoicing purposes, and handles payment processing, applicable sales tax/VAT/GST collection, invoicing and chargeback handling. Payment card data is handled exclusively by Dodo Payments under its own terms and privacy policy, and is never stored on our servers. By purchasing, you also agree to Dodo Payments’ terms and privacy policy as presented at checkout.

4.4 Auto-renewal

Unless you cancel before the end of the current billing period, paid subscriptions renew automatically at the end of each billing period (quarterly) at the then-current price. We (or our payment processor) will notify you in advance of any upcoming renewal in accordance with applicable law. You can cancel at any time as described in Section 5.

5. Refunds and Cancellation

5.1 Cancellation

You can cancel your subscription at any time from your account settings or by contacting contact@sitemaptrends.com. Cancellation takes effect at the end of the current paid billing period; you retain access until then and will not be charged again.

5.2 Refunds

Because the Service is a digital product delivered immediately, we offer a 7-day money-back guarantee: if you request a refund within 7 days of your first paid charge, we will refund the amount paid for that charge, no questions asked. Refund requests after 7 days are considered on a case-by-case basis (for example, where the Service was not delivered as promised due to an error on our end, or where a technical issue caused by the Service prevented you from accessing the features you paid for). 5.3 European Economic Area (EEA) consumers

If you are a consumer in the EEA and you have a statutory right of withdrawal (generally 14 days for digital services), you acknowledge and agree that, by confirming your purchase, you request immediate access to the Service and you consent to the immediate performance of the digital service, thereby waiving the withdrawal period as permitted under applicable law. Our 7-day money-back guarantee in Section 5.2 still applies to you.

5.4 Billing disputes

If you believe you were charged in error, please contact contact@sitemaptrends.com before filing a dispute with your bank or payment provider. We aim to respond within 2 business days and to resolve confirmed billing errors within 5 business days.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to violate any applicable law or regulation.
  • Resell, sublicense or otherwise redistribute access to the Service, or the data obtained through it, without our prior written consent.
  • Scrape, extract or systematically collect data from the Service itself (as opposed to the Service’s intended presentation of its own data to subscribers).
  • Attempt to bypass, disable or interfere with the security features of the Service.
  • Use the Service to infringe the intellectual property or privacy rights of any third party.
  • Misrepresent the data we provide as official or endorsed by any game developer or website operator.

7. Intellectual Property

The Service — including its software, rankings, algorithms, statistical analyses, and presentation — is owned by us and is protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription.

Game names and other trademarks appearing in our rankings belong to their respective owners; we display them solely for identification and analytical purposes. We do not own, and do not claim to own, any third-party games, websites, or their content.

8. Data, Privacy and Security

Your use of the Service is governed by our Privacy Policy, available at https://sitemaptrends.com/privacy-policy/. Payment card data is handled exclusively by our PCI-DSS compliant payment processor, Dodo Payments, and is not stored on our servers. Account data is retained as described in the Privacy Policy and deleted after you close your account.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of the data presented.

9.2 Data accuracy disclaimer

The rankings and statistics we provide are derived from publicly available sitemap data collected from third-party websites. Such data may be incomplete, delayed, or inaccurate, and we make no representation that the Service will enable you to achieve any particular traffic, ranking, or revenue result. Any decision you make based on the Service is your own responsibility.

9.3 Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

10. Term and Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate your account if you materially breach these Terms, engage in suspected fraud, or if required by law. If we terminate the Service for reasons other than your breach, we will refund any prepaid, unused portion on a pro-rata basis. You may delete your account at any time by contacting contact@sitemaptrends.com.

11. Governing Law and Disputes

These Terms and your use of the Service are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws rules. If any dispute arises, please first contact us at contact@sitemaptrends.com to attempt an informal resolution.

12. General Provisions

We may update these Terms at any time. Material changes will be notified at least 30 days in advance by email or in-app notice. Continued use after the effective date constitutes acceptance. If any provision is held invalid, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
